A Study on German¡¸Act on the Donation, Extraction and Transplantation of Organ and tissues¡¹with Focus on its Amendment for the Establishment of Transplantation Registry

Abstract
The purpose of this article is to introduce the revision of German ¡¸Act on the Donation, Extraction and Transplantation of Organs and tissues¡¹in 2016, which concerned with the construction of a centralized organ transplantation registry. Regarding organ transplantation registries, Germany had a de-centralized management system before the amendment of the law in 2016, and it showed a slower pace than Korea, which had already run a centralized registry. However, there are some points related to the German transplantation registry, which have implications for the improvement of the registry management system in Korea, because the handling and protection of personal and medical data in the transplantation medical field is becoming a hot issue in the rapid development of advanced ICT or in facing so called 4th industrial revolution. This article details the revision of the German Act which is characterized by the installation of the specialized Agency for the management of transplantation related data (Transplationsstelle), the establishment of a dedicated authority for encrypting personal and medical data (Vertrauenstelle), and Specifying the organizations and the purpose by and for which it is allowed to use the accumulated data in the registry.
